The landlord returned only a part of my security deposit

 

The Rent Security Deposit act provides that if the landlord returns only some of your security deposit, you can file a complaint against the landlord in the Superior Court for double the amount that you feel that he or she wrongly deducted from the deposit. To do this follow the directions listed below.

  1. Fill out a complaint for the amount of money that the landlord owes you. Remember that you are entitled to ask for DOUBLE the amount of the security deposit that you feel the landlord has wrongly deducted. The law also allows you to ask for reasonable attorneys fees.
  2. You will file your papers in either the Special Civil Part or the Small Claims Section of the Superior Court. The amount of money that you are asking for is what determines the section of the court that you go to in order to file your complaint.
