It has been more than 30 days since I moved out of my apartment and the landlord has not yet returned my security deposit

 

The Rent Security Deposit Act provides that the landlord must return your security deposit to you within 30 days after you move out. If the landlord does not do this you may file a complaint against him or her for double the amount of your security deposit. To do this follow the directions listed below.

  1. Fill out a complaint for the amount of money that the landlord owes you. Remember that you are entitled to ask for DOUBLE the amount of the security deposit. The law also allows you to ask for reasonable attorneys fees.
  2. You will file your papers in either the Special Civil Part or the Small Claims Section of the Superior Court. The amount of money that you are asking for is what determines the section of the court that you go to in order to file your complaint.
